Terms of Service — Landser Outfitters

Overview

This website, landser.com (the "Site"), is operated by Landser Outfitters, LLC ("Landser Outfitters," "we," "us," or "our"). We offer the Site, including all information, tools, and services available on it, to you on the condition that you accept these Terms of Service ("Terms"), along with the policies referenced here, including our Return Policy and Privacy Policy.

By visiting the Site or purchasing from us, you agree to be bound by these Terms. They apply to all users, including browsers, customers, vendors, and contributors of content. If you do not agree to these Terms, do not use the Site.

Any new features or tools added to the Site are also subject to these Terms. Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell our products.

Section 1 — Online Store Terms

By agreeing to these Terms, you confirm that you are at least the age of majority where you live, or that you are the age of majority and have consented to any minor dependents using the Site.

You may not use our products for any illegal or unauthorized purpose, or violate any laws in your jurisdiction when using the Site. You must not transmit any worms, viruses, or other destructive code. Any breach of these Terms may result in immediate termination of your access to the Site.

Section 2 — General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

Your content, other than payment card information, may be transferred unencrypted across various networks and adapted to technical requirements. Payment card information is always encrypted during transfer.

You may not reproduce, duplicate, copy, sell, resell, or exploit any part of the Site or its content without our express written permission. Headings in these Terms are for convenience only and do not affect their meaning.

Section 3 — Accuracy of Information

We are not responsible if information on the Site is not accurate, complete, or current. Site content is provided for general information only, and any reliance on it is at your own risk.

The Site may contain historical information, which is provided for reference only. We may change Site content at any time but have no obligation to update it.

Section 4 — Modifications to the Service and Prices

Prices for our products may change without notice. We may modify or discontinue the Site, or any part of it, at any time without notice. We are not liable to you or any third party for any price change, modification, suspension, or discontinuance of the Site.

Section 5 — Products

Some products are available only online and may be in limited quantities. All products may be returned or exchanged only under our Return Policy (Section 8).

We make every effort to display product colors and images accurately, but we cannot guarantee that your screen will display colors accurately.

We may limit sales of products to any person, geographic region, or jurisdiction, and may limit quantities, on a case-by-case basis. Product descriptions and prices may change at any time without notice, and we may discontinue any product at any time. Any offer made on the Site is void where prohibited.

Section 6 — Orders and Billing Information

We may refuse or cancel any order. We may limit or cancel quantities purchased per person, household, or order, including orders placed under the same account, payment card, or billing or shipping address. If we change or cancel an order, we will try to notify you using the contact details you provided. We may limit or prohibit orders that appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information, and to update it promptly, so we can complete your transactions and contact you as needed.

Section 7 — Shipping, International Orders, VAT, and Duties

We ship from the United States. Delivery times shown on the Site are estimates and are not guaranteed.

International orders may be subject to VAT, import duties, customs fees, and brokerage charges set by the destination country. These charges are the customer's responsibility. They are not included in our prices or shipping fees, and Landser Outfitters is not responsible for paying or refunding them.

All orders are declared to customs as merchandise at their actual value. We will not mark orders as gifts or under-declare their value. You are responsible for knowing and following the import laws of your country. If a shipment is refused, seized, or returned because the recipient declined to pay VAT or duties, any refund will be reduced by our original and return shipping costs.

Section 8 — Return and Exchange Policy

We accept returns and exchanges within 30 days of the date you receive your order, under the following conditions:

  1. Contact us first. Email sales@landser.com with your order number to request a return or exchange. We will send you a Return Authorization (RMA) number and return instructions. Returns sent without an RMA may be delayed or refused.
  2. Original condition required. Items must be returned unused, undamaged, and in their original condition and packaging, with all tags and accessories included.
  3. Refunds are processed only after we receive and inspect the return. Once the item arrives at our address and passes inspection, we will issue a refund to your original payment method, or ship your exchange. No refund will be processed before the item is received.
  4. No restocking fee. We do not charge a restocking fee on returns or exchanges.
  5. Return postage is the customer's responsibility. You pay all costs to ship items back to us. We recommend a trackable shipping service, since we cannot issue a refund for a return we do not receive.
  6. VAT, duties, and customs fees are not refundable. Landser Outfitters is not responsible for any VAT, import duties, or customs charges paid on the original shipment or on the return. Original shipping charges are also non-refundable unless the item arrived damaged or we sent the wrong item.

Damaged or incorrect items. If your order arrives damaged, defective, or incorrect, contact us within 7 days of delivery with your order number and photos. We will arrange a replacement or refund.

Nothing in this policy limits any rights you have under the consumer protection laws of your country.

We may provide access to third-party tools that we do not monitor or control. These tools are provided "as is" and "as available," without warranties or endorsement, and your use of them is at your own risk.

The Site may link to third-party websites not affiliated with us. We are not responsible for their content, accuracy, products, or services, or for any harm from transactions with them. Please review a third party's policies before doing business with them.

Section 10 — User Comments and Submissions

If you send us comments, ideas, suggestions, or other materials ("comments"), you agree that we may edit, copy, publish, distribute, and otherwise use them in any medium without restriction. We have no obligation to keep comments confidential, pay for them, or respond to them.

We may, but are not required to, remove content we consider unlawful, offensive, threatening, defamatory, obscene, or that violates anyone's intellectual property or these Terms. You agree that your comments will not violate anyone's rights, contain unlawful or abusive material, or contain malware. You may not use a false email address or impersonate anyone. You are solely responsible for your comments.

Section 11 — Personal Information

Your submission of personal information through the Site is governed by our Privacy Policy.

Section 12 — Errors, Inaccuracies, and Omissions

The Site may occasionally contain typographical errors, inaccuracies, or omissions in product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct them, change information, or cancel orders at any time without prior notice, including after you have placed an order. We have no obligation to update information on the Site except as required by law.

Section 13 — Prohibited Uses

You may not use the Site or its content:

  • for any unlawful purpose, or to solicit others to take part in unlawful acts;
  • to violate any international, federal, state, or local law or regulation;
  • to infringe our intellectual property rights or those of others;
  • to harass, abuse, defame, intimidate, or discriminate against anyone;
  • to submit false or misleading information;
  • to upload or transmit viruses or other malicious code;
  • to collect or track the personal information of others;
  • to spam, phish, pharm, pretext, spider, crawl, or scrape;
  • for any obscene or immoral purpose; or
  • to interfere with or circumvent the Site's security features.

We may terminate your use of the Site for violating any of these prohibited uses.

Section 14 — Disclaimer of Warranties; Limitation of Liability

We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free, or that results from using it will be accurate or reliable. We may remove or cancel the Site at any time without notice.

Your use of the Site is at your sole risk. Except as expressly stated by us, the Site and all products delivered through it are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

To the fullest extent permitted by law, Landser Outfitters, LLC and its owners, officers, employees, affiliates, agents, contractors, suppliers, and service providers are not liable for any direct, indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost data, or replacement costs, arising from your use of the Site or any product purchased through it. Where a jurisdiction does not allow these exclusions, our liability is limited to the maximum extent permitted by law. In no event will our total liability exceed the amount you paid for the product giving rise to the claim.

Section 15 — Indemnification

You agree to indemnify, defend, and hold harmless Landser Outfitters, LLC and its owners, affiliates, officers, employees, agents, contractors, suppliers, and service providers from any claim or demand, including reasonable attorneys' fees, made by any third party arising from your breach of these Terms or your violation of any law or the rights of a third party.

Section 16 — Severability

If any provision of these Terms is found unlawful, void, or unenforceable, it will still be enforced to the fullest extent permitted by law, and the unenforceable part will be severed. This will not affect the validity of the remaining provisions.

Section 17 — Termination

Obligations and liabilities incurred before termination survive the termination of these Terms. These Terms remain in effect until terminated by you or us. You may terminate them at any time by notifying us or by ceasing to use the Site.

If we believe you have failed to comply with these Terms, we may terminate them at any time without notice and deny you access to the Site. You will remain liable for all amounts due up to the date of termination.

Section 18 — Entire Agreement

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with any policies we post on the Site, are the entire agreement between you and us regarding the Site, and supersede any prior agreements or communications, including prior versions of these Terms. Any ambiguities will not be construed against the drafting party.

Section 19 — Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Orange County, California, and you consent to the jurisdiction of those courts.

Section 20 — Changes to These Terms

You can review the most current version of these Terms at any time on this page. We may update, change, or replace any part of these Terms by posting changes to the Site, and it is your responsibility to check for changes. Your continued use of the Site after changes are posted means you accept them.
